The Constitution gives sole authority to the Congress to raise revenue. This includes tariffs.

Congress has by statute delegated authority to the President to impose tariffs in the event of a national emergency.

Trump has exceeded this delegated authority by falsely declaring a national emergency when there isn't one, ostensibly on the basis of persistent trade deficits attributable to imports by USA consumers.

Warren's proposed resolution denies and pronounces as false the existence of the national emergency which Trump has purported to invoke as the excuse for his tariffs.

The Senate resolution would also need to be passed by the House in order to be considered a binding expression of the will of Congress nullifying Trump's claim of a national emergency.
