Discussing the Supreme Court opinion saying deportations can continue under the Alien Enemies Act, but must provide "due process", the male spokesmodel said to the other male spokesmodel; "so, they must have due process, but there is disagreement about what that might entail". The other male spokesmodel replied; "yes, there is some "confusion" to what that means"
Gee CBS, if only you had some fucking 250 year old document, and 250 years of fucking historical precedent to look at to clear up the "confusion".
It's OK though. I am sure Inside Edition is going to do a story about Kim Kardashians struggle with butt implants, or the Golden Shower Bachelor is giving out a rose tonight.

(2,847 posts)from my observation, reporting on the massive, nationwide, 4/5 protests. On the Monday am CBS morning news (national), I watched for a full 30 min from the start of the program at 7 am. It was weather, tariffs, and basketball. Not one peep about the massive protest by american citizens across the country over the weekend. I turned it off in disgust.

I knew there were MAGATs, or whatever they were calling themselves at any given time, out there. But I had no idea there were so many of them!

Judge Henry Friendly (yes, that was his real name) wrote an influential article which has been accepted by many as a working definition of due process:
A notice of the governments intended action and the asserted grounds for it.
The opportunity for the individual to present the reasons why the government should not move forward with the intended action.
The right for the individual to present evidence , including the right to call a witness .
The right for the individual to see the opposing sides evidence.
The right to cross-examination of the oppositions witnesses.
A decision based exclusively on the evidence presented.
The opportunity to representation by counsel .
The requirement that the tribunal prepare a record of the evidence presented.
Requirement that the tribunal prepare written findings of fact and reasons for its decision .

But that is not in the constitution so, in theory (with this Supreme Court it may be: in fact) the Courts can redefine what is or is not "due process" anywhere along the line.

(45,990 posts)Because if you had, you probably would've learned that what exactly constitutes procedural due process in any particular type of proceeding can vary based on the nature of the proceeding. The commentators on CBS were simply reciting something first year law students should know.

This is first year law school stuff. So let's hear it from those yanking CBS's chain: what exactly will the courts, particularly the Supreme Court, conclude constitutes the level of notice and opportunity for hearing "appropriate to the nature of" a deportation case under the Alien Enemies Act.
Inquiring minds want to know.

It's one of my favorite topics to use in bar prep for my making up the rules sessions because it is so totally situational that the question has to contain enough clues for you to make up crap about what process is due based on the importance of the right that is at risk

It would require a complete lack of knowledge of basic constitutional principles to not understand it.
