NEW YORK (AP) — President-elect Donald Trump on Monday moved to indefinitely postpone this week’s sentencing in his hush money case as he appeals a ruling that upheld the verdict and put him on course to be the first president to take office convicted of crimes.

Trump’s lawyers say the case should be halted automatically while they ask a New York appeals court to reverse Judge Juan M. Merchan’s decision last week, which set the case for sentencing on Friday — little more than a week before his inauguration.

If sentencing proceeds as scheduled, Trump’s lawyers argued, he will be appealing the verdict while in office and will be “forced to deal with criminal proceedings for years to come.” They raised an improbable scenario in which, if Trump wins his appeal, he could be then subjected to another criminal trial while in office.

Merchan rejected Trump’s bid to throw out the verdict in light of his impending return to the White House but signaled that he is not likely to sentence the Republican to any punishment for his conviction on 34 felony counts of falsifying business records. Trump wrote on his Truth Social platform that it “would be the end of the Presidency as we know it” if the ruling is allowed to stand.

Trump has said that it "would be the end of the Presidency as we know it" if the ruling is allowed to stand.

Trump's lawyers argued Monday that their appeal to the Appellate Division of the state's trial court should trigger what's known as an automatic stay, or pause, in the proceedings. If that doesn't happen, they said, Merchan should step in and halt Friday's sentencing.

Acknowledging the demands of the transition process, he had given Trump the option to attend in person or appear virtually by video.

Trump's lawyers argued in court papers Monday that their planned appeal to the Appellate Division of the state's trial court triggers what's known as an automatic stay, or pause, in the proceedings. If that doesn't happen, they argued, Merchan should then grant a pause and prevent sentencing from happening on Friday as scheduled.

that TSF will be held accountable by a court?

I mean the Supreme Court pretty much said he is above the law.

TSF doesn't have Mickey Mouse lawyers now, someone is paying his legal fees.

I will be pleasantly surprised if Trump is sentenced on the 10th.

Even when he loses in court such as his Trump University scam, a Las Vegas casino owner paid his 25 million dollar fine.

This is what I keep asking every time someone says "Garland" in the federal cases.

The SCOTUS with the SAME 6-3 fascist-supporters that we see today, were in place BEFORE January 6, 2021, and no matter when anyone started investigating, the result would have been the same.

Anyone assuming that the SCOTUS would have somehow not allowed the criminality to proceed at any point in time from right after the 2020 election and on, is dreaming. He appointed 1/3rd of them, and they have overruled the Appeals Courts that objected.

There was only 1 president.

The J6 committee even sent Garland criminal referrals for Ken Chesebro and Mark Meadows, with evidence. Garland shit canned those referrals.

Michigan SOS Dana Nessel sent Garland a criminal referral, with evidence, for her fake electors. Garland shit canned those.

Mueller laid out the evidence to prosecute Trump for obstruction of justice. Garland ignored it.

Garland did indict and convict Peter Navarro and Steve Bannon for blowing off subpoenas. That is Garland's main accomplishment of prosecuting Trump's inner circle.

The fuckers who were working for Trump are now headed to high positions in his cabinet instead of being in jail.

Garland had no idea what the Supreme was going to do. Saying it didn't matter that Garland failed to act is a cop out.

THAT is the "Supremacy".

And as I have posted over and over - the STATES are responsible for "elections" and how they are handled and THAT meant the selection of Electors.

Why do you think that Congress had to AMEND the Electoral Count Act, which was done in 2022 (hint, partly because of that very problem of the Electors)?

And with respect to Mueller - THAT was all done under Bill Barr and we know what Barr did with it - basically a "cased closed".

The obsession with Garland mirrors the DU obsession with Eric Holder and is just tiresome. These people are figureheads - as much as people hate when I call them that but THAT is what they are. Anyone who has worked for the federal government quickly learns that these Department heads come and go and a new one comes in to take their place eventually. Wash. Rinse. Repeat.
