President-elect Donald Trump told NBC News Meet the Press moderator Kristen Welker in a phone interview Saturday that he will most likely give TikTok a 90-day reprieve from a potential ban in the U.S. after he takes office Monday.
Trump said he hadnt made a final decision but was considering a 90-day extension of the Sunday deadline for TikToks China-based parent company to sell to a non-Chinese-buyer or face a U.S. ban.

So...
It's not clear if TikTok has met the high legal bar to win a 90-day reprieve from Trump -- which requires having binding agreements in place to enable ByteDance to complete a sale of TikTok by mid-April

(6,227 posts)... which, If I understand correctly, would entail not going after apple and google if they do not remove it from their app stores. There isn't really a direct ban on tt. It is a ban on distribution of the app.
The executive branch is allowed discretion as to which laws are enforced most vigorously.

Actually, one pundit was avidly saying that perhaps he should just ignore the law because we're a democracy and the president, being democratically elected, represents the people. (Well, d'uh, you'd think Congress might do the same. And apparently that idjit would say we'd be wrong.)
Another was sarcastic about that possibility and called it "executive nullification"--Congress makes suggestions that the president signs to indicate he'll take it under advisement, apparently.
Sometimes it's not just worth chewing through the restraints in the morning.

Where does it say in there anything about upholding the law?
I have to do this: /s

(26,154 posts)There's a legal provision that allows for a 90 day reprieve.
But that's it. There would have to be a new law passed or a purchaser found in that time.

(31,506 posts)Real estate mogul Frank McCourt, who is trying to buy TikTok's U.S. arm, reiterated his investor group's ability to make a deal and still comply with the Supreme Court's ruling on Friday.
Why it matters: Billionaire McCourt says he has the money and the technology to keep TikTok running on American phones.
Zoom in: McCourt appeared on CNBC on Friday after the Supreme Court upheld a U.S. law that requires ByteDance, TikTok's Chinese parent company, to either sell the app or shutter it inside the U.S. The ban would go into effect on Jan. 19.
McCourt pointed out that if the U.S. version is sold, the law says it needs to be disentangled from the Chinese technology that runs it.
"We, I believe, are the only bidder that meet that criteria," he told CNBC.
ByteDance has previously indicated that TikTok is not for sale.
