Lawyer for E. Jean Carroll says Trump wants to delay $5 million payment in sex abuse, defamation case

Lawyers for President Trump asked for writer E. Jean Carroll's consent to delay the $5 million awarded to her by a 2023 jury, and signaled they plan to ask the Supreme Court to reconsider his appeal of Carroll's sexual abuse and defamation case, according to an attorney for Carroll.

Carroll's lawyer, Roberta Kaplan, wrote in a court filing Tuesday that Mr. Trump's lawyer called her with the request Monday, soon after the Supreme Court declined to hear his appeal. Later Monday, Kaplan wrote, she informed Mr. Trump's team that "Carroll does not consent," and asked whether the president would agree to the immediate disbursement of the funds Carroll has waited years to receive.

In a separate filing Tuesday, Kaplan asked a judge to set a faster-than-normal schedule to disburse $5 million in damages awarded to her by a 2023 jury, which found Mr. Trump liable for sexual abuse and defamation. Kaplan wrote that Carroll is also due an additional $779,783 in interest.

Kaplan said she intends to motion the federal court in New York for the funds' release, and requested "that the court direct [Trump] to respond to the motion within seven days, or by July 7, 2026, rather than the usual fourteen days." She pointed to a June 2023 filing in which she said the two sides agreed Carroll could collect if the Supreme Court denied a petition to hear the case. The court did so Monday.

The petition must be filed within 25 days and can only be granted if supported by one of the justices who supported the decision to which the reconsideration petition is directed. Consequently such petitions almost never are granted.

So, while the losing parties in Dobbs and the immunity case (not”we”) could have filed a reconsideration petition they didn’t because they knew it wouldn’t have been granted.

The agreement with the escrow account says the money would be released to Carroll if SCOTUS declined to hear the case, which has happened.

All it will take is the lower court judge to order the release of the funds.

My money is on Trump suing the escrow company to block the release of funds.

I spent many years dealing with scum bags like Trump. They know every trick, every delaying tactic and are expert in manipulating the system for their benefit.

In one case, I took a file that had been going on for 5 years, I carried it for 6, and it was dragged out another 3 year after I left.

Our system is really good but there are so many guys like Trump and his attorneys that have identified every loophole and procedural action and use them to delay, delay and delay.

was stayed by each level of the appellate process and will be stayed while this disaster works its way thru this part.

Is this wrong? Yes but the law allows it.

This is why I say that chasing professional debtors is really tough as they know, use and abuse every loophole and procedural dodge that they can.

They will tell you that they may eventually have to pay out, but they will take as long as they can to delay it (it feeds their twisted egos).

Trump's lawyers asked Carroll's lawyers to agree to a stay pending disposition of a motion for reconsideration of the cert. denial. Carroll's lawyers said no and asked Trump's lawyers if they would agree to the immediate disbursement of the funds. Trump's lawyer said he needed until July 2 to get back to Carroll's lawyer. Rather than wait around, yesterday, Carroll's lawyer filed a motion seeking disbursement of the funds. In addition, Carroll's lawyers asked that the time for Trump to respond to that motion -- normally 14 days -- be shortened to 7 days stating that "given the cost to Plaintiff of further delay in this nearly four-year-old litigation, we submit that there is good cause to adopt a modestly compressed briefing schedule as to payment of the judgment." The judge granted that request for an expedited schedule today, giving Trump until July 7 to respond to Carroll's motion for disbursement.

when you have a PITA professional dirtbag...errrrrr...debtor, is extremely difficult.

PITA debtors dispute the validity of the judgment, which, when facing an unfriendly judge, essentially makes you relitigate the whole case. Appeals tend to go nowhere, as Florida is considered one of the (if not the) most debtor-friendly states in the country. Exacerbating it even more so is when the debtor has the assets to fund such a fight.

Been there, done that, and have the t-shirt.

If he hadn’t had help by Musk, Thiel, Eaton Corp, Leonard Leo and the Federalist Society, the USPS,

Obviously he has enough money (and the money to pay this judgment is being held by the court anyhow). But once it's actually paid out to Carroll and sitting in her bank account, the loss is final and official. He had to fork over a pile of bucks to a woman because he was found to have defamed and sexually assaulted her and she now has his money once and for all to prove it. It's that he's a loser and finally had to pay up for being a loser that he can't stand.

When the Supreme Court declined to consider President Donald Trump’s appeal against E. Jean Carroll on Monday, she moved a step closer to collecting her $5 million (plus interest) from one of the two civil cases she won against him.

On Tuesday, her lawyers said the president was still trying to put off paying but that it was “the end of the line” and “time for him to pay Carroll.”

They made those statements in a court filing to the New York district court that oversaw her 2023 trial, where a jury found Trump liable for sexually abusing the writer in 1996 and defaming her in 2022. Carroll’s lawyers said that “after four years of litigation across every level of the federal court system, it is time for this case to end.”

The latest potential hitch is that her lawyers said a lawyer for Trump has asked if they would agree to further delay so he can ask the Supreme Court to reconsider its refusal to review his petition. Carroll’s lawyers declined another postponement, noting a prior stipulation between the parties provides for payment upon the denial of Trump’s petition.

They added that there’s no reason to think the court would reconsider its denial, seeing as it just rejected Trump’s petition without any justices signaling interest in the case. It takes four justices to grant review.

“Accordingly, the Court should direct the Clerk to disburse to Carroll the value of the judgment including post-judgment interest, which amounts to $5,779,783.00 in total as of the date of this filing,” Carroll’s lawyers wrote to the district court on Tuesday. They urged the court to “reject his latest effort to delay and instead bring this long-running litigation to an end.”
