Arizona secretary of state must release list of voters affected by MVD glitch, judge rules

Secretary of State Adrian Fontes must release the list of voters who are affected by a registration glitch that has allowed thousands to vote without having to provide proof of citizenship, a judge ruled Thursday.

The records, which affect as many as 216,000 voters who will still be allowed to vote next week, must be released by noon Monday, Maricopa County Superior Court Judge Scott Blaney ruled. But his decision is unlikely to affect Tuesday's election.

Blaney directed EZAZ, a right-leaning activist group that sought the list under the state's public records law, to share the information only with the 15 county recorders and certain state lawmakers. Those officials must sign an agreement to not share the data with third parties, and EZAZ members cannot use the information to contact any of the voters on the list until the day after Tuesday's election, Blaney ruled.

EZAZ chairwoman Merissa Hamilton said the point of the lawsuit was to get this data to the county recorders so they can update their voter files and to state lawmakers so they can do their oversight duty.
