Florida Democrat files resolution to lower threshold to pass constitutional amendments to 50%
A Democratic lawmaker wants to give Florida voters the chance to repeal a constitutional amendment that led to popular proposals on the 2024 statewide ballot to legalize recreational cannabis and restore abortion rights to come up short.
The resolution (SJR 864 ) filed on Wednesday by Orlando-area state Sen. Carlos Guillermo Smith would allow voters to decide whether to reduce the threshold to pass constitutional amendments in Florida from its existing 60% to 50%.
Florida voters in 2006 raised that threshold in a constitutional amendment (that ironically passed by just 58%). Since that was implemented, measures that have won the support of the majority of Floridians have still fallen short if they failed to get 60%.
That includes the two biggest measures on the 2024 ballot: Amendment 3, which would have legalized recreational cannabis for adults 21 and older, and Amendment 4, which would have restored the right for a woman to have an abortion in the state up until “viability,” around 24 weeks. The state now bans most abortions after six weeks.
