Oakland County judge temporarily extends order blocking abortion prosecutions

An Oakland County judge extended a temporary order Wednesday barring prosecutors in Michigan's biggest counties from criminally charging abortion providers under a state law that bans most abortions.

But that extension is temporary, only in place until he decides whether to implement an order that could ban 13 prosecutors from considering criminal charges for months to come.

Oakland County Circuit Court Judge Jacob J. Cunningham announced at the start of Wednesday's hearing that he'd extended his temporary restraining order, issued recently in light of a flurry of legal activity. But after hearing about two hours of testimony, parties needed more time to ask questions of witnesses before Cunningham could issue a decision.

Cunningham said the court would reconvene at 9:30 a.m. Thursday. He's expected to rule on a preliminary injunction at the conclusion of that hearing or shortly thereafter. If he institutes one, it's anticipated that order will be appealed.
