NH Supreme Court says hand counting of ballots isn't constitutionally required

Sep. 12—The New Hampshire Supreme Court ruled Thursday that hand counting of ballots isn't required under the state's constitution, after an Auburn man argued ballot counting machines shouldn't be used at polling places.

The court ruled the plaintiff, Daniel Richard, demonstrated standing to bring an equal protection claim regarding ballot counting devices, which was remanded back to the trial court for additional proceedings.

"Thank you for all the prayers and support," Richard said Thursday in a direct message to a reporter.

The state Supreme Court took up Richard's case after he appealed a decision in 2022 by Rockingham County Superior Court rejecting his lawsuit against Gov. Chris Sununu and legislative leaders.
