Judge to rule on Alec Baldwin bid to avoid 'Rust' trial

May 17 (Reuters) - A New Mexico judge was expected to rule on Friday whether to throw out the involuntary manslaughter case against actor Alec Baldwin in the 2021 shooting of cinematographer Halyna Hutchins during filming of the Western movie 'Rust.'

Baldwin's lawyers have filed motions to dismiss his indictment, alleging prosecutorial misconduct, opens new tab, a failure to show the actor committed a crime, and destruction of evidence, during testing of the gun Baldwin was using during a rehearsal on the film's New Mexico set.

District court Judge Mary Marlowe Sommer scheduled a 10:00 a.m. virtual hearing, on the defense motions Friday after which she is expected to rule on them.

It may be Baldwin's last chance to avoid what Hollywood historians regard as an unprecedented manslaughter trial of a leading actor for an on-set death.

1. I get his notion. But he was holding the gun. I don't think he was criminally involved. But he was holding the gun ...

...it's called a trial not a condemnation. It's a search for truth and I think it's an opportunity to close the door on further accusations.

… the weapon was safe was found guilty. As was the assistant director who called “cold gun” as he handed it over.

Baldwin is a victim of an idiot armorer, a lax assistant director, and a political botched prosecution.

Baldwin is about to have the case dismissed - and rightfully so. The prosecution has been a clown show from the beginning.

... as loaded. Empty, blanks, normal rounds, they're all loaded. They don't get pointed, and the triggers don't get pulled. Blanks kill, too.

I know, it was on a "shoot", the revolver needed to be loaded for the "shot". Maybe Baldwin is not trained in firearm safety, but that firearm was in his control. I understand he wasn't criminally responsible, and that trial will establish it without any doubts, legally.

I hope they drug tested the armorer. this was a terrible misstep.

He was doing directorial work when that gun was needlessly pointed at a human by himself.
