Denver DA seeking to revoke bond for former APS deputy superintendent

The Denver District Attorney’s Office is preparing a motion today seeking to revoke bond in two different felony cases pending against the former deputy Albuquerque Public Schools superintendent who resigned last week, according to a Denver DA spokesperson.

Colorado court records show Jason Martinez, who is listed by his full name Timothy Jason Martinez in court records, is facing a felony charge of assault with a deadly weapon causing injury stemming from an arrest by Denver police in January of this year.

That’s in addition to a 2013 felony case involving charges of sexual assault of a child that has been set for trial in early October in Denver.

Lynn Kimbrough, of the Denver District Attorney’s office, said bond for each case was set at $50,000. “There was some surprise that this particular individual was working out-of-state,” Kimbrough told the Journal.

"Jason Martinez was the hand-picked deputy superintendent of the Albuquerque Public Schools making $160,000 a year.

A jury trial is set on the child sex abuse charges, which involve two victims, an 8-year-old and a 13-year-old.
While on bond in that case, Martinez was arrested on assault charges on Jan. 25 of this year related to an altercation involving his boyfriend.

An amended set of charges filed in July 2012 by Denver prosecutors allege a pattern of sexual abuse that began in 2010, when Martinez was working for Denver Public Schools.

In the 2013 case, he is charged with Class 3 and 4 felonies. A Class 3 felony is punishable by up to 12 years in prison, and a Class 4 felony is punishable by up to six years in prison.
In the 2015 case, the most serious count is a Class 4 felony, the range again is up to 6 years in prison if convicted."
