Hank Kuczynski speaks out after judge tosses ballots in Saratoga special election

Saratoga Springs, N.Y. — The results of the Saratoga Springs DPW special election were a topic of conversation at a city council meeting Tuesday Night.

The race was decided on February 14th when Judge James Walsh ruled that 90 of the 106 write-in votes for Democrat Hank Kuczynski were invalid due to extraneous markings. Republican Chuck Marshall won by a margin of 65 votes.

CBS6 spoke with Democratic Attorney Sarah Burger Tuesday evening, and she said they are still considering appealing the ruling by Judge Walsh. Walsh cited decisions from 1990 and 2013 that ruled the whole ballot is void if the voter makes any extraneous marks.
