No charges will be filed against Kyle Carruth in connection with the Nov. 5 fatal shooting of Chad Read at a south Lubbock residence.
Carruth's attorney, David Guinn, on Thursday evening said officials with the Texas Attorney General's office, which was investigating the case, said a grand jury, specially impaneled to review the shooting, declined to indict Carruth on Thursday.
Guinn expressed, on his client's behalf, his sympathies to the Read family.
"The loss of life is painful," he said. " (Carruth's) deepest sympathies go out to them."
He also expressed gratitude for the grand jury's decision, saying the judicial system worked as it should.

For those who do not recall, Mr. Read showed up to pick up his children at the home of Mr. Carruth who was seeing Read's former wife. The two became involved in an argument on the front porch. Mr. Carruth walked into his home and grabbed his gun when Mr. Read tried to take the gun away from him and was shot. Video at link below.

(18,017 posts)What should have happened was his former wife and Carruth should have disengaged from Read and went back into their residence. If Read physically attempted to prevent them from doing this or attempted to enter the residence, then it would be a justified shooting. As it stands bringing a long gun into a heated argument seems wrong.
On the other hand don't screw with somebody who is armed. Just leave especially when you have already effectively been trespassed.
