BREAKING: Federal Court enters consent order in which USPS agrees to prioritize processing and delivering of ALL absentee ballots ahead of Election Day in Virginia.

Lawsuit filed on behalf of the Democratic Party of Virginia against the U.S. Postal Service over its failure to process and deliver election-related mail in a timely manner, potentially leading to the disenfranchisement of Virginians seeking to cast absentee ballots for the statewide election on Nov. 2. The complaint argues that the Postal Service’s failure to delivery absentee ballot applications and ballots in a timely manner will significantly burden and potentially disenfranchise thousands of Virginia voters in violation of the First and 14th Amendments. The lawsuit asks the court to order the Postal Service to prioritize and expedite the processing of election-related mail and to immediately process any unscanned election materials in Albemarle, Portsmouth and James City Counties, where delays are of particular concern. The plaintiffs filed a motion for a temporary restraining order and preliminary injunction in line with these requests, after which the parties agreed to certain terms to ensure the timely delivery of election mail. Specifically, the Postal Service will: 1) ensure that completed absentee ballots being returned to county elections officials are properly postmarked and scanned; 2) expedite the delivery of completed absentee ballots; and 3) conduct an “All Clear Certification Process” daily through next Friday. Nov. 5 where employees sweep all locations and certify that facilities are “clear of all Election Mail committed for delivery that day.” The Postal Service will provide daily reports to the DPVA about the “All Clear” process from the previous day, as well as estimates of travel times for completed absentee ballots.

3. I hope that they will be able to do it, but I am pessimistic.

Edit: I'm mainly referring to the ballots that never got delivered to voters in this post.

In Charlottesville (Albemarle) I'm still receiving 4 week old first class mail mailed in Charlottesville. I doubt that they can find all the ballots in that office in a week. If they have been presorted in Sandston (all mail goes there and back to Charlottesville) they will be mixed in the backlog of all mail.

The ballot that arrived here after 4 weeks was scanned in Sandston and never scanned again. We dropped it off at the Registrar.

4. Yea, it's definitely cutting it close (too close for comfort).

I did VBM this year and mailed it back (last year I delivered it directly to the drop box). I received my ballot in mid September and mailed it back the following day then I tracked my ballot to ensure receipt and it was received within a week. I'm in JCC by the way.

5. I grew up in JCC

At my last visit I couldn't find any trace of my former abode. The hill the house was on is even gone. It was near the intersection of Ironbound Road and Old News Road. That was out in the country back then.

We were down to one or two deliveries a week in September and had one week with none. There have been manpower issues here at the PO for at least a decade. DeJoy just put the nail in the coffin. Strange but 7 days a week the Amazon deliveries kept happening.

6. What's the enforcement? Inspectors, observors, or more lawsuits after the fact?

7. Yes, it doesn't mean that the SOB DeJoy will abide by the order.

I hope any enforcemnnt is not by the DOJ or it will never happen.
