Voters sue after Madison failed to count their absentee ballots
A prominent progressive law firm intends to bring a class action lawsuit against the city of Madison for failing to count 193 absentee ballots that were misplaced following the November election, the firm announced Thursday.
The announcement came a day before state election officials are set to review an unprecedented investigation of the errors, which weren’t reported to state officials until after they could be included in Wisconsin’s tally of the election results.
The Madison city clerk’s office first informed the public on Dec. 26 about the unprocessed ballots from three wards near downtown and the University of Wisconsin-Madison campus. That disclosure was six weeks after a first batch of 68 ballots was found in a tabulator machine, sealed in an envelope inside a sealed courier bag.
That machine came from the polling site at Madison West High School and involved 67 absentee ballots for Ward 65 and one mis-sorted ballot for Ward 68.
