Congress
Related: About this forumOctober Surprise for Trump
Hi there
I wasn't sure where to put this and it might have already been discussed but
During the impeachment hearings there was some talk about how the Duck was a traitor but no one ever got specific as far as the Constitution goes.
Well, first off the President has not Constitutional authority to impose tariffs that it the authority of the Congress (Article 1 section 8)
Second the President has no authority to allocate funds as he tried to do with the unemployment problem (Article 1 section 9).
The President shall not receive any monies other than those he receives as salary (Article 2 Section 1)
I would hope that the Lincoln Project and the Republicans against Trump are able to realize this and push it to the limit.
Now technically these may not be considered treasonable acts but they are impeachable AND they violate or subvert the stated intent of the Constitution.

Yes it's impeachable but in practice that won't happen.
But what *can* happen is he can be forced to return all that money.

(7,582 posts)They've made MILLIONS while working as public servants. All of their private income needs to go into the Treasury. They made that money on OUR DIME. It goes to US. And THEN they can be punished for crimes.

(54,197 posts)I agree we should go after them, but there are specific laws that apply, we need to use whatever that process is.
But for the presidency, the constitution specifically prohibits any emoluments beyond salary from either the federal or state governments. So I think we can simply declare any such payment void and demand it back.
He's not entitled to that money.

(22,967 posts)Of course, you're correct. So, tell me why Senate Republicans didn't call for any witnesses or evidence in Trump's impeachment trial? (snark)
By the way, the best place to put most posts, if they're not really subject-specific, is General Discussion. Almost anything is pretty cool there.
Have a good week, wolfie54.
