In a new report, Amnesty International concludes: "Israel has committed genocide against Palestinians in Gaza." Paul O'Brien, the Executive Director of Amnesty International USA, joins Chris Hayes to discuss.

1. The last estimate I saw from the

UN was a couple of months ago but based on satellite imagery and reports on the ground they estimated over 60% of the buildings in Gaza have major damage. Many just gone. Likely lots of bodies to be discovered yet and I doubt whether Israel will allow a full inspection of the damage before they "clean up".

3. Amnesty International admits on pg. 101 of its report that it made up its own definition of "genocide"

rather than use the actual legal definition found in the Geneva Convention on the Prevention and Punishment of Genocide.

Amnesty International found the legal definition articulated in detail in the Geneva Convention to be "overly cramped", so they cobbled together their own personal definition, relying on vague appeals to "international jurisprudence", conflations of the standards for charging individuals with the crime of genocide with standards for charging a state with the crime, and cribbed, decontextualized sentences from a dissent in the ICJ case Croatia v Serbia.

Amnesty International rejects the explicit terms of the Geneva Convention itself and the recent rulings of the ICJ because neither supports AI's claims.

The ICJ has held that “in order to infer the existence of dolus specialis from a pattern of conduct, it is necessary and sufficient that this is the only inference that could reasonably be drawn from the acts in question”, meaning that “intent to destroy the group, in whole or in part, must be the only reasonable inference which can be drawn from the pattern of conduct.

I guess Amnesty International correctly surmised that folks like Chris Hayes would never bother to actually read the report and would merely breathlessly parrot the explosive and inaccurate headline.

Israel’s war in Gaza has killed at least 44,612 Palestinians and wounded 105,834 since 7 Oct 2023. On 15 Aug 2024 the IDF claimed more than 17,000 militants have been killed. Who are the remaining 27,612 deaths?

At this rate, nearly 48,000 Palestinians in Gaza will have been killed by air and drone strokes by year's end. These figures exclude West Bank casualties.

5. It is disingeniouis to say 'this isn't genocide!'

Just because it doesn't fit perfectly into a previous description of the term.
(But apologists will continue to play pointless word games.)

Meanwhile, the Special Military Operation continues unabated in Gaza while desk-jockeys out of the kill zone quibble over using the word "genocide."
