2016 Postmortem
Related: About this forumLawyers: If WI Recount Reveals Count Fraud and Hillary Won, Can the Supreme Court be Petitioned
to Order a Halt to the Electoral College Vote pending recounts in other close states?
I know it is doubtful that the WI count will change, but if the "impossible" happens and there is overwhelming evidence of error, fraud, or misconduct that is likely in other states, could an argument be made that the safe harbor date be extended and EC vote be delayed a couple of weeks to allow for proper counts? I know Justice Breyer proposed a one week extension in Florida that was not agreed to in 2000, but suppose he got five votes? Can the Supremes effectively order such a recount?

Even more than overturning the election, it is
OUR VOTING SYSTEMS that must be reformed.
The elites of both sides will resist this, relentlessly.
Just watch.

(10,357 posts)A 4-4 tie in SCOTUS would affirm the lower court (Court of Appeals) decision.
Sure, anything is possible. Who would have thought the court would stop a state from counting votes in 2000? If that is possible, why not ordering other recounts?

(525 posts)I just checked out the composition of the US Court of Appeals for the Third Circuit, which includes PA. That court has 12 judges, 2 vacancies. Seven judges appointed by Democrats.
So my Democratic attorney friends, I sure hope you are not waiting for the WI recount to be completed before crafting the paperwork, rational, etc. necessary to file in Federal Court in Philadelphia. Or perhaps a direct request to the 3rd circuit appellate court!
