The Manhattan District Attorney's Office has decided not to prosecute two high-level NYPD officials accused of assaulting Occupy Wall Street protesters.
Deputy Inspector Johnny Cardona is accused of assaulting a man, while Deputy Inspector Anthony Bologna is also accused of pepper spraying a female protester.
After an investigation, the DA's Office said they cannot prove the allegations were criminal beyond a reasonable doubt.
A law enforcement source told NY1 that officers were reacting during a chaotic scene, and that evidence before and after the incidents makes the criminality of their actions doubtful.

(11,064 posts)If Holder ever gets around to prosecuting high-level police officials who implemented policies of using unconstitutional unnecessary and excessive force to inhibit disfavored speech, that would be a surprise.

(4,775 posts)The DA has negative incentive when it comes to prosecuting cops. In these cases we need an outside Public Prosecutor, someone who doesn't normally work on the side of police during prosecutions.
