Related: About this forumI was pistol whipped last night and broke my nose.
At a pub last night. Another person who I did not know say at a table across from me out back ( in the smoking area). I assume we know a mutual person who apparently was lying about me. All the drama aside, we had an heated exchange of words. He pulled up his shirt, exposing his pistol. I yelled at him, asking if he was going to shoot me. I don't know how, but the next moment, I felt something extremely hard and heavy, lights out. My head and nose felt like one of those spring door stops. From what little I could see, there was blood everywhere.
Blood was still pouring from my nose when I went inside, everyone gasping and pointing, to ask the bartender to call 911. I went and sat down outside on the curb, and no one came out to help me. 20 minutes later, I went inside and asked if an ambulance was coming.
They hadn't called anyone!!
I started screaming at them to fucking call 911, that a crime had been committed, and that I was in need of medical help. My nose was still dripping blood all over the place. I finally shamed them into calling the police which took a few minutes more!
So, they waited around 25 to 30 minutes before calling 911.
Can I sue the bar?
Edit: a cook was a witness.
The police came last night and I told them they had cameras. They didn't file a report! They were treating me like a suspect. I had to ask one cop to stop questioning me, and that I wanted to talk to the other one.
I talked to a very nice police officer this morning who confirmed that a report has not been filed, but that he was filling one and a detective will be calling me soon.

FYI: I'm not sure where you live but laws vary from place to place. For example, I live in NJ. If you not a government official, 1%er or celebrity, you have no chance of getting a CC permit at all. The person who attacked you is guilty not only of aggravated assault but also, in most places, brandishing.

I don't know how stupid these guys can be. I'll let them continue to incriminate themselves, though.
At this point, I'm letting the police handle it.

(7,309 posts)When he showed me his gun, I said, "You must know ..." to which he confirmed. The mutual person has been making up lies about me for about 10 or 11 months. I wasn't there to defend myself. This stranger confronted me about them, and that's how I knew it was the mutual person.

(122,689 posts)that the bar's failure to call 911 when you asked them to somehow made your injury worse. Also, they would probably argue that after you went outside, it appeared to them that you weren't badly hurt and had simply left the premises on your own. They could claim they thought you'd left and so didn't see any reason to call 911. On the other hand, in some jurisdictions, if you are a business invitee (customer), a business has a general duty to aid an injured person or take reasonable steps to prevent them from being injured. But you'd still have to prove the bar's failure to act caused or worsened your injury. You should contact a lawyer in your area for specific advice.
