Per current laws, migrants claiming asylum upon entry are entitled to due process, and given a scheduled court date. If their asylum claim is denied at their hearing, which most are, they are then scheduled for deportation.

The cruelty is letting people establish a life here while knowing they are likely to be denied asylum, and then expecting them to go back to their country of origin.
