$175K settlement reached in suit against Doņa Ana county treasurer [View all]

LAS CRUCES - A $175,000 settlement has been reached in a lawsuit filed against Doña Ana County Treasurer David Gutierrez by his former chief deputy.

The Las Cruces attorney representing Rene Barba – Gutierrez’s former chief deputy who alleged under the Whistleblower Protection Act that he was fired in January in retaliation for not agreeing to hire Gutierrez as his chief deputy if he were to be elected treasurer this year – disclosed the settlement amount on Thursday.

“This amount to the settlement was $175,000,” Barba’s attorney, Joleen K. Youngers, told the Sun-News, adding that Barba had lost a year of income and benefits. “Mr. Barba would have been employed for the remainder of the treasurer’s term, which end this year, had he not been fired.”

The Sun-News was not immediately able to confirm the settlement amount with county officials by press time Thursday evening.
