If the commission doesn't draw the lines, the red-leaning state supreme court will (likely very close to these lines).

Who then do you appeal to? You could ask a federal district judge to overturn a state supreme court on racial grounds - and the 4th circuit might uphold it... but what chance is there of SCOTUS letting that stand?

The problem is... the map isn't particularly "gerrymandered" (certainly not when compared to the alternative proposed above). It just favors republicans because democrats "pack" themselves.
