That is the law. Police do not have unlimited time and energy. Even if they spent the time and energy and tracked the guy down, what would they do? What would be the sentence that a court would impose on him? Get real.

If a homeless guy spit in my face and disappeared I would wash my face and get on with my life. I would not waste the time of 911 operators and police officers with the event.
