(46,051 posts)39. I'd like for those DUers criticizing CBS to explain what due process requires in the deportation cases
Seventy-five years ago, the Supreme Court stated as follows: Many controversies have raged about the cryptic and abstract words of the Due Process Clause, but there can be no doubt that, at a minimum, they require that deprivation of life, liberty or property by adjudication be preceded by notice and opportunity for hearing appropriate to the nature of the case.
This is first year law school stuff. So let's hear it from those yanking CBS's chain: what exactly will the courts, particularly the Supreme Court, conclude constitutes the level of notice and opportunity for hearing "appropriate to the nature of" a deportation case under the Alien Enemies Act.
Inquiring minds want to know.

CBS is absolutely correct. We don't know how DOJ will handle this and it's doubtful immigrants will get a fair hearing.
